Summary: Amends the State Universities Civil Service Act. In provisions concerning appointments and promotions, changes references from the Director of the University Civil Service Merit Board to the Executive Director of the University Civil Service Merit Board. Provides that if a position needs to be filled, the Executive Director shall certify to the employer the names and addresses of the persons with the 3 highest scores on the appropriate register (instead of the names and addresses of the 3 persons standing highest on the appropriate register); makes related changes. Provides that if a superior position in the promotional line is to be filled, the Executive Director shall certify to the employer, in the order of their seniority, the names and addresses of the persons with the 3 highest scores on the appropriate promotional register (instead of the names and addresses of the 3 persons standing highest upon the appropriate promotional register). Removes language that provides that sex shall be disregarded except when the nature of the position requires otherwise.

SB 1: PA 98-599

Summary: "The State Universities Annuitants Association and Illinois Attorney General Lisa Madigan reached a tentative agreement to postpone implementation of the State’s new pension law (PA 98-599). The agreement is pending as it requires judicial approval before going into effect. The agreement delays implementation of the pension law until July 1, 2015. Specifically, the agreement protects SURS members currently eligible for retirement by allowing them to delay their retirement decision until the constitutionality of the new pension law is determined. It allows them to calculate their money purchase annuity based on the effective rates as of June 30, 2014 and allows them to avoid the skips in the annual increases if the changes to the pension are upheld. The agreement also ensures that any unnecessary pension contributions will be refunded."

SB 2196: Public Act 098-0596

Summary: As you are probably aware, return to work provisions for SURS retirees were revised through the passage of Senate Bill 2196 and signed into law as Public Act 98-0596 by Governor Quinn on Tuesday, November 19, 2013. Some significant changes that were developed and successfully included in the new law are as follows: 1. Establishment of a common academic year (September 1) for tracking purposes. 2. Removal of the 18-week limitation. 3. Exception to the 40% threshold and financial consequences if the retiree’s position is governed by the State Universities Civil Service Act (110 ILCS 70).

Summary: Amends the State Universities Civil Service Act. Changes references from "Director" to "Executive Director" of the University Civil Service Merit Board. With respect to principal administrative employee positions exempted from the State Universities Civil Service System, provides that the positions must be approved by the Merit Board (instead of as determined by the Merit Board). Provides that no position may be exempt unless the exemption has been reviewed and approved by the Merit Board or by the Executive Director as delegated by the Merit Board. Provides that the authority to exempt lies solely with the Merit Board or the Executive Director as delegated by the Merit Board, and such authority shall not be extended to any other employing institution or agency. Provides that adequate advance notice of the intent to propose an exemption must be provided to impacted employees and any labor organization with exclusive bargaining rights for that position and posted in all public places allocated for civil service employment information. Provides that the Merit Board and any committees and subdivisions thereof shall be subject to all provisions of the Open Meetings Act. Provides that the Merit Board is a "public body" within the meaning of that term as set forth in the Open Meetings Act. Provides that the Merit Board and any committees and subdivisions thereof shall be subject to all provisions of the State Records Act. Provides that the Merit Board is an "agency" within the meaning of that term as set forth in the State Records Act. Provides that notwithstanding any provision of law to the contrary, any authority granted to the Merit Board to make and publish rules is strictly limited to the requirements of the Illinois Administrative Procedure Act, and no authority for the Merit Board to make and publish rules exists outside of the requirements of the Illinois Administrative Procedure Act. Provides that the Merit Board is an "agency" within the meaning of that term as set forth in the Illinois Administrative Procedure Act.
